1. Agreement to Terms
By accessing or using The Well Place website (ourwellplace.com), purchasing any products or services, or engaging with any of our digital content, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use our services or purchase our products.
2. Services and Products Provided
The Well Place provides holistic wellness services including, but not limited to: bioenergetic scans and assessments, personalized wellness protocols, health coaching and consultations, digital resources (client portals, video walkthroughs, written summaries), and nutritional supplements.
3. Medical Disclaimer
IMPORTANT: Dr. Kaylan Jackson, Ph.D. is a Scientist, Holistic Nutritionist, and Wellness Expert. She is NOT a Medical Doctor (MD) and does not practice medicine, diagnose medical conditions, prescribe medications, or perform any surgical or medical procedures.
All information, services, and products provided by The Well Place are intended for educational and wellness purposes only and are not meant to replace treatment, diagnosis, or advice from a licensed medical professional. You should always consult with your healthcare provider before beginning any new health regimen, including the use of supplements.
4. Supplement Disclaimer
FDA DISCLAIMER: The statements made regarding supplements and wellness products have not been evaluated by the Food and Drug Administration (FDA). These products are not intended to diagnose, treat, cure, or prevent any disease.
Individual results may vary. You are responsible for consulting with your healthcare provider before using any supplements, especially if you are pregnant, nursing, taking medications, or have a medical condition.
5. Payment Terms
All payments are processed securely through our third-party payment processors (including but not limited to Squarespace, Afterpay, and other payment platforms). By completing a purchase, you authorize us to charge the payment method you provide for the total amount of your order, including any applicable taxes and shipping fees.
6. Refund Policy
ALL SALES ARE FINAL. Due to the personalized nature of our services and digital products, refunds are not available once services have been delivered or digital products have been accessed.
Digital Services (Non-Refundable Once Delivered):
This includes bioenergetic scans and written results, video walkthroughs and recorded consultations, personalized wellness protocols and supplement recommendations, access to client portals (such as Notion) or any digital resources, and email delivery of results or materials. Once your results, portal access, or digital materials have been sent to the email address you provided at checkout, the service is considered delivered and complete.
Physical Products (Supplements):
All supplement sales are final once shipped. We do not accept returns on supplements due to health and safety regulations. If you receive a damaged or incorrect product, please contact us within 7 days of delivery at support@ourwellplace.com with photos of the issue, and we will work to resolve it.
7. Chargebacks and Payment Disputes
By purchasing from The Well Place, you agree that filing a chargeback or payment dispute after receiving your services or products constitutes a breach of these Terms and Conditions.
If you file a chargeback or payment dispute after your services or products have been delivered, The Well Place reserves the right to: (a) submit evidence of delivery and service completion to the payment processor or financial institution; (b) immediately suspend or terminate your access to any client portals, digital resources, or future services; (c) pursue collection of any amounts owed, including the original purchase amount and any chargeback fees incurred by The Well Place; and (d) report the dispute to credit agencies or collection services if necessary.

8. Digital Delivery and Acknowledgment
By purchasing a digital service or product, you acknowledge and agree that: (a) delivery occurs when materials are sent to the email address you provided at checkout; (b) email delivery constitutes receipt of the service, regardless of whether you open, read, or download the materials; (c) it is your responsibility to provide an accurate email address and to check your inbox (including spam/junk folders) for delivery; and (d) failure to access delivered materials does not entitle you to a refund or chargeback.
9. User Obligations
You agree to: (a) provide accurate and complete information about yourself when making purchases or using our services; (b) update your information as necessary; (c) use our website and services in compliance with all applicable laws and regulations; (d) not share, resell, or distribute any digital materials, protocols, or content you receive from The Well Place; and (e) take personal responsibility for your health decisions and consult appropriate professionals as needed.

The Well Place offers SMS messaging for appointment reminders, service notifications, shipping updates, and promotional content related to our wellness services.
Message Frequency
You may receive up to 10 SMS messages per month from The Well Place, depending on your interactions with our services.
Message & Data Rates
Standard message and data rates may apply. Please contact your mobile carrier for details about your plan.
Opt-Out
You may opt out at any time by replying STOP to any message. After opting out, you will receive a one-time confirmation and no further messages unless you re-subscribe.

11. Confidentiality
Your privacy is important to us. All personal and health information shared during sessions or through our services is kept confidential, except as required by law. As wellness professionals, we are required to report situations where there is a credible threat of harm to oneself or others, or where a minor or vulnerable adult may be at risk.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WELL PLACE, DR. KAYLAN JACKSON, AND ANY EMPLOYEES, CONTRACTORS, OR AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM: (a) your use of or inability to use our services or products; (b) any decisions you make based on information or guidance provided; (c) any adverse reactions to supplements or wellness protocols; (d) any third-party services, products, or websites referenced or linked; or (e) any other matter relating to our services.
You acknowledge that you use our services and products at your own risk and that you are solely responsible for any results or consequences.

You agree to indemnify, defend, and hold harmless The Well Place, Dr. Kaylan Jackson, and any employees, contractors, or affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney fees) arising from: (a) your violation of these Terms and Conditions; (b) your use of our services or products; (c) your violation of any third-party rights; or (d) any dispute between you and a third party relating to our services.
14. Dispute Resolution
Any disputes arising from these Terms or your use of our services shall first be addressed through good-faith negotiation by contacting support@ourwellplace.com. If a resolution cannot be reached within 30 days, either party may pursue mediation or binding arbitration in accordance with the laws of the State of [Your State].
